This conference continues the series of events dedicated to all aspects of tourism law. The Sawiris Resort in Andermatt, which has been in planning and construction for eighteen years now, is the ideal venue for this event. It is considered one of the most outstanding large-scale tourism projects in the Alps and is linked to a multitude of legal proceedings and decisions that have reached a new dimension in terms of density and scope. This fifth conference is dedicated to new developments in second homes and Lex Koller, as well as travel law. After an initial block covering the latest political and legal developments since the last conference, the second block will focus on second home legislation, namely the revision of Art. 11 para. 2–4 ZWG concerning homes subject to the old law, based on the Candinas parliamentary initiative. It then addresses the current debates on tightening the Lex Koller and the Bürgenstock Resorts case study, in particular with regard to management obligations and rental pools. Finally, the third block is devoted to the important topic of travel law in the tourism industry. Here, the focus will be on air passenger rights in the event of delays and the Package Travel Act, in particular the complex relationship between national and EU law and the possible implications.
